Cancellation of events
Should Biermann Services have to cancel the event (e.g. due to sudden illness of the speaker, force majeure) we will suggest a postponement date. If this is not possible for you to accept, we will of course refund the participation fees paid. Further liability and compensation claims, which do not concern the injury of life, body or health, are excluded, as far as there is no intention or gross negligence on our part.
Documentation
The documents made available within the framework of further training are prepared to the best of our knowledge and belief. Liability and guarantee for the correctness, topicality, completeness and quality of the contents are excluded.
The disclosure to third parties, i.e. to persons who are neither work colleagues nor employees of the customer, or the public dissemination or making available of course materials or teaching materials is not permitted. In particular, the publication of audio or video data, digital presentations or scripts in publicly accessible Internet portals (sharing) is prohibited.
Photo and video recording
Photographs of the participants can be taken at the events as part of a photo protocol. These photo logs are only made available to the participants of the course in the learning environment. If you do not agree to your person being photographed or the photo protocol being uploaded to the learning environment, please contact Biermann Services.
Some events may also include taking pictures of participants on photos or videos. Should the photographs be used for advertising purposes, we will obtain your consent separately prior to the event.
Learning platform
We are entitled to block your access to the learning platform without giving reasons if you have not used the services offered by us for a period of 3 years. The user will be informed of an imminent blocking by e-mail within a period of 4 weeks.
Warranty
We strive to provide permanent access to the learning platform (365 days, 24h). However, availability at any time is expressly not guaranteed. In particular, access may be temporarily restricted for technical reasons, such as necessary maintenance and repair work.
Secrecy
The relationship of trust between all parties requires strict confidentiality. We therefore undertake to treat as confidential and/or proprietary all information, data, or documents belonging to the user or the associated company, whether written or oral and including but not limited to ideas, concepts, methods, etc., and to keep such information, data, or documents confidential or proprietary. In particular, we undertake not to sell, trade, publish, reproduce or otherwise disclose such Confidential Information to any person or entity without the prior written consent of the User and the entity. The above obligations, are not applicable to information which:
• are already in the possession of the public or will become accessible to the public through channels other than through an act or omission by us;
• must be made public in accordance with law, government order or court order
• provided that the user and the company are informed immediately.
• Cases in which there are legal obligations with regard to the exchange of information or in which we are explicitly released by the user or the company from their obligation of confidentiality are excluded from this provision.
Once the purpose for which the Confidential Information was acquired has been achieved, we will immediately return to or destroy all originals and copies of the Confidential Information.
Liability
The website of Biermann Services and/or eLearnings contains links to websites of third parties. Biermann Services provides these links as an additional service or as a courtesy. Biermann Services has no influence on the content of linked third-party websites. Therefore, we are not liable for the correctness, topicality and completeness of the information given there. Furthermore, we expressly distance itself from the content of all linked pages. Biermann Services does not assume any warranty for the functionality and/or correctness of the pages or the data, services or work offered on them and is under no circumstances liable for damages or consequential damages or any kind of loss caused directly or indirectly by the operation, non-operation, use or application in any form. We draw attention to the fact that contractual relationships with third parties are only established in accordance with their terms and conditions.
Place of jurisdiction
All disputes shall be governed by Swiss law with the place of jurisdiction being Sankt Gallen.
Final provisions
A dispute settlement procedure before a consumer mediation body is not involved.
